General
Pfänderbahn AG acquired contracts for the transport of goods and persons exclusively on the basis of the conditions of transport, stated in these General Terms and Conditions. Deviations of the conditions by a contract partner, in particular of travel agencies and coach organizers, shall only apply if written agreement has been made with the Pfänderbahn AG. The Terms and Conditions of Business remain valid, even in the case of any invalidity of individual provisions. All additions or amendments to the General Terms and Conditions of Business or contracts require a written agreement with the Pfänderbahn AG. This also applies to any waiver of the written form requirement.
Passengers and contract partners take note that the persons attributable to the company, are not authorized to make statements which are based on these General Terms and Conditions of Business of the Pfänderbahn AG.
The Conditions of Transport, particularly those for children, apply to the respective lifts of Pfänderbahn AG for all transports.
Control and Misuse
At Pfänderbahn AG the validity of the ticket is checked by card readers. The lift tickets and entitlement certificates for special rates (e.g. ID cards) are to be provided to the employees of Pfänderbahn AG on request. The calendar year is not transferable.
The 1, 2, 4, 8 and 12 time travel tickets are transferable. 1 and 2 time travel tickets are valid for a period of one year. 4, 8 and 12 time travel tickets are valid from one to two years.
The subsequent exchange for another lift card, or a shift of the validity period is not possible. Any misuse will result in the immediate withdrawal of the lift ticket and collection of a penalty fare according to the applicable general tariff provisions. We reserve the right to file an official complaint. Exclusion from the transport is carried out as a result of violating the transport regulations. In severe cases, withdrawal of the lift ticket without replacement, and an official complaint is filed with the local authorities.
Mediation for Third Party Services
The Pfänderbahn AG offers combined trams with the Vorarlberg lines, as well as packages with the Berghaus Pfänder, the Gasthaus Pfänderdohle and Carriage Rides only as an intermediary for these services and companies. Pfänderbahn AG will not become the contractual partner of the customer.
The respective General Terms and Conditions of the sales partner apply to these services.
Loss of train tickets
Generally, lost lift tickets are not replaced. The loss of a season pass can be reported to our cash desk, the names of season pass holders are secured in a digital file. Upon presentation of proof of purchase, and proof of identity, it is possible to block the lift ticket. Payment of a deposit fee, and proof of purchase is required to obtain a replacement card. A replacement card cannot be issued without proof of purchase.
Reimbursements
The non-use of the lift ticket due to bad weather, failure of facilities, illness, injury, or unforeseen circumstance, does not constitute a claim for reimbursements or extensions.
General Rates
The General Rates price list, and the officially approved Terms and Conditions of Transport form an integral part of the Contract of Transport. By purchasing a ticket, the passenger acknowledges the following regulations, and commits themselves to abide by them.
All information in brochures, circulars and catalogs of suppliers, which are not printed on the brochures of the Pfänderbahn AG or, are not listed on the homepage of Pfänderbahn AG, are non-binding.
Purchase of vouchers
Persons 18 years of age and older are authorised to order vouchers. Purchasing a voucher shall be deemed as acceptance of the terms and conditions. The vouchers are the property of Pfänderbahn AG until full payment has been made and are only valid after receipt of the full amount. Pfänderbahn AG reserves the right to invalidate the vouchers at any time during the automated processing. Value vouchers do not include value-added tax due to the impossibility of assigning the service content. The purchased or ordered vouchers are to be consumed by accepting services provided by the Pfänderbahn AG and cannot be redeemed in the form of a cash payment. A selection of value vouchers (assigned a specified monetary amount) are available. If the consumption of a service is higher than the value of the voucher, the difference must be paid. If the consumption is lower than the value of the voucher, the remaining value remains on the voucher. No liability is accepted for late delivery by post. Vouchers have no expiry date and can be redeemed at any time. Each voucher can only be redeemed once, which is ensured by a barcode or voucher number associated with the voucher. The customer is obligated to provide the relevant data requested completely and correctly when concluding the transaction. In the event of incorrect, incomplete and unclear information provided by the customer, the customer shall be liable for any and all costs and damages incurred.
Mountain Tip / Trail Liability
The mountain area around the Pfänderbahn AG is alpine terrain. It is recommended that travelers wear suitable clothing and footwear.
During the summer months the weather can change quickly. Passengers are encouraged to consider the weather, and use appropriate clothing, footwear, and other accessories.
The trails/paths on the Pfänder are not owned by Pfänderbahn AG, and are owned by Third Parties. Pfänderbahn AG does not have any path owner’s liability. In winter, there is no service on these roads.
Law and jurisdiction
For all contracts concluded between Pfänderbahn AG and its contractual partner, and for all claims arising from the legally effective existence or non-existence of these contracts, the application of substantive Austrian law shall be agreed under exclusion of the provisions of Austrian Private International Law.
The competent court of jurisdiction of Bregenz is the exclusive court of jurisdiction for all disputes, unless legally excluded. However, the company may also challenge the contractual partner at another domestic or foreign jurisdiction.
Data protection and data processing
Insofar as personal data is made available by the contractual partner, it will be used to process inquiries and/or bookings, to provide the services of the Pfänderbahn AG and for administrative purposes. The contracting party agrees that their personal data may be stored and processed as necessary for this purpose. The personal data will be treated as strictly confidential in accordance with the provisions of the Data Protection Act and will not be sold to third parties or marketed in any other way. The personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the business transaction or if personal data must be disclosed due to legal regulations.
