They apply to the carriage of passengers and goods, as well as conduct on railway premises.<\/p>\n\n<p class=\"wp-block-paragraph\">The performance of the contract of carriage\u2014and thus the effectiveness of these Terms and Conditions of Carriage\u2014begins upon arrival at and ends upon departure from the portions of the facility designated for cable car operations.<\/p>\n\n<p class=\"wp-block-paragraph\">By purchasing a ticket, the passenger acknowledges the following terms and conditions and agrees to comply with them.<\/p>\n\n<p class=\"wp-block-paragraph\">A violation of the terms and conditions of carriage may also result in liability under the law.<\/p>\n\n<h2 class=\"wp-block-heading\">Obligation to Provide Transportation<\/h2>\n\n<p class=\"wp-block-paragraph\">The cable car company is obligated to provide transportation in accordance with the schedule if<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The applicable laws and regulations and the terms and conditions of carriage are complied with, as well as the cable car company\u2019s instructions issued in the interest of safety and order, and<\/li>\n\n\n\n<li>the transport is not prevented by circumstances that the cable car company cannot avert and is unable to remedy.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Exclusion from Transportation<\/h2>\n\n<p class=\"wp-block-paragraph\">Persons who are intoxicated, or who fail to comply with the provisions of these Terms and Conditions of Carriage or with any additional instructions issued by the cable car company to ensure safety and order, or who are obviously unable to do so due to their physical or mental condition, are prohibited from riding.<\/p>\n\n<h2 class=\"wp-block-heading\">Tickets<\/h2>\n\n<p class=\"wp-block-paragraph\">Passengers must have a valid ticket. Tickets are generally non-transferable; exceptions are specified in the fare schedule. The validity period of tickets is indicated on the ticket itself or specified in the fare schedule.<\/p>\n\n<p class=\"wp-block-paragraph\">The ticket must be presented upon request for inspection or validation. If the ticket is in such a condition that its validity can no longer be determined, a new ticket must be purchased.<\/p>\n\n<p class=\"wp-block-paragraph\">A passenger found traveling without a valid ticket after the start of the trip must, without prejudice to any criminal prosecution, pay the fare for the trip as well as the additional fare specified in the fare regulations. The start of the trip is defined as entering and exiting the inspection zone or the rail facility.<\/p>\n\n<p class=\"wp-block-paragraph\">In the event of attempted or actual misuse of a ticket, and without prejudice to any criminal prosecution, the ticket will be confiscated without compensation, and the additional fare specified in the fare regulations will be charged.<\/p>\n\n<p class=\"wp-block-paragraph\">If a passenger refuses to pay the fare or the additional transportation fee immediately, the cable car company\u2019s employees are entitled to request that the passenger present identification and to deny boarding of said passenger.<\/p>\n\n<p class=\"wp-block-paragraph\">No replacement will be provided for lost tickets.<\/p>\n\n<h2 class=\"wp-block-heading\">Refund<\/h2>\n\n<p class=\"wp-block-paragraph\">If the service is not provided for reasons attributable to the cable car company or in accordance with Section 5b), the fare will be refunded in full for single-ride tickets; otherwise, a partial refund will be provided. The amount of the refund is determined by the fare schedule.<\/p>\n\n<p class=\"wp-block-paragraph\">If transportation is not provided for reasons attributable to the passenger, there is no entitlement to a refund of the fare\u2014except in cases of non-use following winter sports accidents.<\/p>\n\n<h2 class=\"wp-block-heading\">Passenger Conduct<\/h2>\n\n<p class=\"wp-block-paragraph\">The following rules apply to passenger conduct before, during, and after transportation:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Passengers must conduct themselves in such a way that the safety of the cable car operation and the passengers is not endangered, and that order and the smooth operation of the facility are not disrupted.<\/li>\n\n\n\n<li>Passengers may only enter those railway facilities and areas within the stations that are designated for public use or for passengers.<\/li>\n\n\n\n<li>Once the station doors open, passengers must board the cable car cars as quickly as possible. Stay clear of the doors after boarding.<\/li>\n\n\n\n<li>The cable car doors open and close automatically. It is prohibited to prevent or interfere with the opening and closing process. Passengers who require assistance getting on or off the train must explicitly inform the station attendant.<\/li>\n\n\n\n<li>Smoking is prohibited at the stations and while the train is in motion.<\/li>\n\n\n\n<li>If the cable car comes to a stop while in operation, passengers must remain calm and await instructions from the cable car staff.<\/li>\n\n\n\n<li>It is prohibited to hold objects out of the window or throw them out of the vehicle.<\/li>\n\n\n\n<li>After the cable car has arrived, please exit the platform in the direction indicated.<\/li>\n\n\n\n<li>Passengers on the cable car must strictly observe the prohibitions, instructions, and notices that apply to them, which are generally indicated by symbols and signs.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Transportation of Children<\/h2>\n\n<p class=\"wp-block-paragraph\">The following applies to the transportation of children:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Children shorter than 1.10 m may only be transported if accompanied by a suitable adult.<\/li>\n\n\n\n<li>An accompanying person is considered suitable, in particular, if he or she is regarded as an adult under the provisions of the collective bargaining agreement and appears clearly capable of providing any assistance that may be necessary.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Bringing Items Onboard<\/h2>\n\n<p class=\"wp-block-paragraph\">Passengers may carry lightweight, non-bulky items weighing up to 10 kg in total, as well as one piece of winter sports equipment, subject to the space available on the vehicle.<\/p>\n\n<h2 class=\"wp-block-heading\">Damage and Contamination<\/h2>\n\n<p class=\"wp-block-paragraph\">Any person who damages or defiles the cable car\u2019s facilities, rolling stock, or other equipment must pay the repair or cleaning costs. Furthermore, any intentional damage will be reported to the authorities.<\/p>\n\n<h2 class=\"wp-block-heading\">Animal Transport<\/h2>\n\n<p class=\"wp-block-paragraph\">Animals are permitted on board provided that their transport is not expected to interfere with safe operation, the owner keeps the animal secure during transport, and any passengers on board do not object.<\/p>\n\n<h2 class=\"wp-block-heading\">Freight Transport<\/h2>\n\n<p class=\"wp-block-paragraph\">Goods will be accepted only by separate agreement.<\/p>\n\n<p class=\"wp-block-paragraph\">Luggage will not be accepted for transport or storage.<\/p>\n\n<h2 class=\"wp-block-heading\">Transportation of Goods<\/h2>\n\n<p class=\"wp-block-paragraph\">Goods will be accepted for transport only by prior arrangement. The transport of goods may be refused if facility or operational conditions do not permit it, or if such transport could jeopardize the safety and operation of the cable car.<\/p>\n\n<h2 class=\"wp-block-heading\">Denial of Transportation<\/h2>\n\n<p class=\"wp-block-paragraph\">The following are excluded from transportation:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Goods that require special equipment for loading.<\/li>\n\n\n\n<li>Goods which, in the cable car company\u2019s judgment, are likely to cause dirt or damage to the car during transport.<\/li>\n\n\n\n<li>Items that are unsuitable due to their size, weight, or nature.<\/li>\n\n\n\n<li>Goods, whose transport is prohibited under applicable laws.<\/li>\n\n\n\n<li>Goods that are classified as dangerous goods pursuant to the Federal Act on the Transport of Dangerous Goods by Road (GGST), BGBL. 1979\/209, as amended, are accepted for transport only up to the maximum quantities and subject to the provisions governing such transport, provided that weight and space constraints permit, as permitted under the BM\u00f6WuV Regulation of May 7, 1987 (Small Quantities Regulation), Federal Law Gazette 1987\/220, as amended.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Loading and Unloading<\/h2>\n\n<p class=\"wp-block-paragraph\">The shipper or consignee must always arrange for the loading and unloading of the goods, taking into account and complying with the instructions of management and its employees.<\/p>\n\n<p class=\"wp-block-paragraph\">The cable car company determines the time of transport at its sole discretion. Transport will only begin if, according to a notification from the cable car company to the destination station, the recipient has made the necessary arrangements for immediate unloading.<\/p>\n\n<p class=\"wp-block-paragraph\">Upon arrival at the destination station, the consignee must accept the shipments immediately. The consignee will not be specifically notified of the shipment\u2019s arrival. The consignee is responsible for taking delivery of or unloading the goods (see Section 23).<\/p>\n\n<h2 class=\"wp-block-heading\">Freight Ledger and Payment<\/h2>\n\n<p class=\"wp-block-paragraph\">The goods to be transported are recorded in a freight log.<\/p>\n\n<p class=\"wp-block-paragraph\">Freight charges are to be calculated according to the rate schedule and paid at the time of shipment (exceptions by agreement).<\/p>\n\n<h2 class=\"wp-block-heading\">Authorization<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Pf\u00e4nderbahn AG Bregenz<\/strong><br\/>Approved by decision of the BM\u00f6WuV dated May 11, 1995<br\/>Ref.
